10. Payment and Fees

General

These Bitcoin Payment Terms & Conditions (“Bitcoin Terms”) apply to your use of Bitcoin as your selected payment method for eligible our products and services in certain jurisdictions.  Please read these Bitcoin Terms carefully.  By using Bitcoin as your method of payment, you acknowledge and agree to be bound by these Bitcoin Terms.

These Bitcoin Terms apply in addition to the terms and conditions contained in the Order Agreement and Motor Vehicle Purchase Agreement.  If there is a conflict between these Bitcoin Terms and the Order Agreement or Motor Vehicle Purchase Agreement with respect to Bitcoin transactions, these Bitcoin Terms apply.  If you do not agree with any of the terms and conditions in these Bitcoin Terms, do not select Bitcoin as your payment method. We reserve the right to change, suspend, remove, disable or impose access restrictions or limits on our acceptance of Bitcoin as a payment method for our products and services at any time without liability to you, in our sole and absolute discretion.

Paying with Bitcoin

To make a payment in Bitcoin, you need a digital wallet that supports transfers of Bitcoin to external digital wallets, compatible hardware and Internet access.  If you decide to make an eligible purchase with Bitcoin, you must select Bitcoin as the payment method for your purchase when we prompt you to select a payment method.  We will provide to you a digital wallet address (“Bitcoin Address”) in both alphanumeric and QR code form.  This is the payment address location to which you will need to send Bitcoin from your digital wallet.  You may copy and paste or manually input the alphanumeric code that we provide to you into the recipient field in your digital wallet software or, if your digital wallet software supports QR codes, scan the QR code that we provide to you using your device to auto-populate the recipient field with the alphanumeric code.  PLEASE NOTE THAT IT IS YOUR RESPONSIBILITY TO CONFIRM AND VERIFY THAT THE ALPHANUMERIC CODE THAT WE PROVIDE TO YOU IS ACCURATELY REFLECTED IN THE RECIPIENT FIELD OF YOUR DIGITAL WALLET SOFTWARE.  YOU MUST EXERCISE CARE WHEN INPUTTING THE BITCOIN ADDRESS INTO THE RECIPIENT FIELD BECAUSE BITCOIN TRANSACTIONS CANNOT BE REVERSED.  WE ARE NOT RESPONSIBLE FOR ANY FAILURE TO ACCURATELY INPUT THE ALPHANUMERIC CODE INTO THE RECIPIENT FIELD.

All products are priced in U.S. Dollars. You must pay an amount of Bitcoin that is of equivalent value to the U.S. Dollar purchase price of the product that you purchase.  We will provide you with a U.S. Dollar price for the product or service that you are purchasing, as well as a Bitcoin equivalent price through the checkout process  (the “Bitcoin Price”).

Bitcoin Network Fees

You are responsible for directly paying all Bitcoin network fees (“Transaction Fees”) associated with the transaction, separate and apart from the Bitcoin Price.  If your digital wallet software does not automatically generate a Transaction Fees amount for you, you must calculate the amount of Transaction Fees necessary for the transaction to process on the Bitcoin network.

Bitcoin Payments are Final

Once you initiate a Bitcoin transaction, the transaction cannot be reversed.  This is inherent in the nature of the Bitcoin network; not a policy set by us.  YOU ARE RESPONSIBLE FOR VERIFYING THAT THE AMOUNT FIELD IN YOUR DIGITAL WALLET SOFTWARE IS CORRECT.

Bitcoin Network Protocols

We do not own or control the underlying software protocols that govern the operation of the Bitcoin network. The Bitcoin network protocols are open source, and anyone can use, copy, modify, and distribute them.  We are not responsible for operation of the Bitcoin network protocols.  The Bitcoin network protocols are subject to sudden changes in operating rules (e.g., forks), and such changes may materially affect the value, function, and/or even the name of Bitcoin. WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY FAILURE OF THE BITCOIN NETWORK PROTOCOL THAT RESULTS IN A FAILED PAYMENT OF BITCOIN TO US OR OTHERWISE INVOLVES YOUR BITCOIN PAYMENT.

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act, which can be found here http://www.copyright.gov/legislation/dmca.pdf, and specifically in accordance with 17 U.S.C. § 512(c)(3), we will respond expeditiously to claims of copyright infringement committed using the Company Website if such claims are reported to Company’s Designated Copyright Agent identified below.

If you are a copyright owner or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the Website by completing a DMCA Notice of Alleged Infringement and delivering it to Company’s email. Upon receipt of Notice as described below, we will take whatever action in our sole discretion as we deem appropriate, including removal of the challenged content from the Website. Please note that if you fail to comply with all of the requirements of this section and of 17 U.S.C. § 512(c)(3), your DMCA notice may not be valid.

  • Identify the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by your Notice, you may provide a representative list of the copyrighted works that you claim have been infringed.
  • Identify the material or link you claim is infringing (or the subject of infringing activity) and to which access is to be disabled, including at a minimum, if applicable, the URL of the link shown on the Website or the exact location where such material may be found.
  • Provide your company affiliation (if applicable), mailing address, telephone number, and email address.
  • Include both of the following statements in the body of the Notice:
    • “I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).”
    • “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of, the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
  • Provide your full legal name and your electronic signature.
  • Deliver this Notice, with all items completed, to Company’s  Email: info@lyceumtutoring.com

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright holder, the holder’s agent, or pursuant to law, to post and use the material in your content, you may send a counter-notice containing the following information to Lyceum (Shells to Satoshi)’s email:

  • Your  electronic signature;
  • Identification of the content that was removed or to which access has been disabled as a result of mistake or a misidentification of the content; and
  • Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court El Salvador, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, we may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in ten business days. Unless the copyright owner files an action seeking a court order against Lyceum (Shells to Satoshi) or the person who has posted allegedly infringing content, the removed content may be replaced, or access to it restored, in ten business days or more after receipt of the Counter-Notice.

Lyceum (Shells to Satoshi) does not condone or tolerate copyright infringement or any violation of the intellectual property rights of Lyceum (Shells to Satoshi) or of others. Lyceum (Shells to Satoshi) reserves the right to terminate the access and/or use privileges of any person who has been determined to be a ‘repeat infringer’ of the copyrights of Lyceum (Shells to Satoshi) or others. Lyceum (Shells to Satoshi) reserves the right to define the criteria by which Lyceum (Shells to Satoshi) will determine that a person is a ‘repeat infringer.’ In the event that ‘repeat infringer’ is defined by statute, law, or regulation as applicable to 17 U.S.C. § 512, Lyceum (Shells to Satoshi) will adopt that definition as a minimum standard. Without limiting Lyceum (Shells to Satoshi)’s right to define ‘repeat infringer,’ as a general rule, Lyceum (Shells to Satoshi) will define a ‘repeat infringer’ as any person or entity about whom Lyceum (Shells to Satoshi) has received two or more DMCA Notices of Alleged Infringement. Lyceum (Shells to Satoshi) will take into account all relevant facts and circumstances when determining whether or not termination of access and/or use privileges of a ‘repeat infringer’ is appropriate.

REGARDLESS OF WHETHER Lyceum (Shells to Satoshi) TERMINATES ACCESS AND/OR USE PRIVILEGES OF ANY PERSON OR ENTITY, ‘REPEAT INFRINGER’ OR OTHERWISE, Lyceum (Shells to Satoshi) IN NO WAY WAIVES ANY RIGHT TO PURSUE ANY AVAILABLE REMEDY AT LAW OR IN EQUITY AGAINST COPYRIGHT INFRINGERS OR ANY OTHER INTELLECTUAL PROPERTY RIGHTS VIOLATORS, NOR WILL Lyceum (Shells to Satoshi) INDEMNIFY OR PROVIDE LEGAL REPRESENTATION TO ANY ALLEGED INFRINGER IN ANY ACTION ARISING FROM THE ALLEGED INFRINGER’S USE OF ANY Lyceum (Shells to Satoshi) WEBSITE OR SERVICE, EXCEPT AS EXPRESSLY DESCRIBED IN THIS NOTICE.
